BLUF: Don Lemon got arrested by federal agents on January 30th. He was charged under the FACE Act and a dusty Reconstruction-era conspiracy law for being at an anti-ICE protest that crashed a church service in St. Paul, Minnesota. The Left is screaming "fascism." The Right is screaming "justice." The truth? The truth is irrelevant to these people. But if you watch and read the indictments and video then you’ll realize both sides are playing you for a fool..
Everybody has a loud-ass opinion on Don Lemon right now. If you open X, you’ve got the Left clutching their pearls, claiming this is the death of the First Amendment and the rise of the Fourth Reich. Then you’ve got the Right doing victory laps, acting like Don Lemon personally burned down the Constitution, and that locking him up is the height of patriotism.
Neither side has watched the full video. Neither side has read the indictment. If they did and are only telling half-truths then they have an agenda. I guarantee you, neither side gives a damn about the actual law.
So let’s do something that seems to be illegal in America these days: Let’s look at what actually happened. Not what CNN says (they fired him anyway). Not what Fox says. We are going to look at the tape, the court documents, and the absolute clown show that is our Department of Justice.
Don Lemon, former CNN anchor turned independent YouTuber, was arrested at a posh Beverly Hills hotel around midnight on January 30th. He wasn’t in a trench coat in an alley; he was in LA covering the Grammys. The FBI and Homeland Security picked him up on a federal warrant out of Minnesota.
The charges? Conspiracy against religious freedom and "injuring, intimidating, or interfering" with people exercising their right to worship. These are heavy federal crimes.
Attorney General Pam Bondi immediately took a victory lap on social media. The White House official account posted "When life gives you lemons..." which, honestly, is petty as hell for an official government channel, but that’s the world we live in. The circus started immediately.
Here’s the thing though: A federal judge in Minnesota had already rejected the arrest warrant. Chief Judge Patrick Schiltz looked at the evidence and basically told the DOJ to kick rocks, saying there was no emergency and the government was acting "frivolous." So what did the DOJ do? They went around the judge and went straight to a grand jury to get the indictment anyway.
That should piss you off, regardless of whether or not you agree with Lemon’s tactics.
THE CONTEXT
You can't understand the stupid without understanding the sad. Here is what set this powder keg off.
On January 7, 2026, an ICE agent named Jonathan Ross shot and killed Renee Good, a 37-year-old mother and U.S. citizen, during an operation in Minneapolis. Then, another U.S. citizen, Alex Pretti, was killed by feds. Minneapolis was emotionally on fire. People were pissed, and they had a right to be.
Protesters did some digging and found out that David Easterwood, the pastor at Cities Church in St. Paul, wasn't just a man of God. He also serves as the acting field director of the local ICE field office. That’s the connection. That’s why the protest went to a church. It wasn’t random.
On January 18th, a few dozen protesters, including Lemon, entered the church during a Sunday service.
Now, context on Lemon: He got canned by CNN in 2023. He’s been running "The Don Lemon Show" on YouTube. He claims he’s an independent journalist. But let’s be serious for a second and note that his version of journalism is just being a mouthpiece for the Left. He met with the organizers before the event. He livestreamed the pre and he followed them to the church.
He wasn't the only reporter there: Georgia Fort, another independent journalist caught a stray; but Lemon is the one making headlines because, well, he’s Don Lemon.You are who you hang out with though.
THE REALITY CHECK
This is the meat of the sandwich. This is where we separate "journalism" from "activism" and the "law" from the "political hit job."
What the Video Actually Shows
Lemon livestreamed this whole thing. We have the receipts.
Before the church: Lemon is in a grocery store parking lot meeting with protesters. He turns the camera on and calls it a "resistance" operation. He explicitly tells his viewers he can’t say where they are going because it’s a "clandestine mission." He tells a co-defendant, "Don't give anything away."
Folks, if you are a reporter, you usually don't talk about being on a "clandestine mission" with the people you are covering. That sounds less like reporting and more like you’re driving the getaway car. This is the DOJ’s strongest evidence. He sounds like part of the team.
At the church: It gets ugly. The protesters walk in during the service. They start chanting "ICE Out!" and "Justice for Renee Good." They take over the main aisle and the front rows. According to the indictment, they called congregants "Nazis" and told kids their parents were going to burn in hell.
If you haven’t watched the video it’s long, but you should at least skim through to understand the situation.
Parents couldn't get to their kids. The children were in a downstairs childcare area, and protesters were blocking the stairs. One lady actually fell and got hurt trying to leave. That’s not a protest; that’s a mob. If you block parents from their kids, you deserve a kick in the ass (even in the house of God), I don't care what your political cause is.
Lemon specifically: The Washington Post and others reviewed the footage. Lemon was inside for about 45 minutes. He interviewed 4 parishioners and 5 protesters. He didn't scream. He didn't chant. He told people, "I'm not here as an activist. I'm here as a journalist." A pastor asked him to leave, and about seven minutes later, he walked out.
However, the indictment claims Lemon "largely surrounded" a pastor and got so close that the pastor’s hand grazed him. Lemon’s response on tape? "Please don't push me." He also said on his stream, "You have to be willing to go into places and disrupt and make people uncomfortable."
So, did his words cross the line? He planned it. He knew the goal was disruption. He called it a "mission." That’s a gray area the size of Texas.
What the Hell is the FACE Act?
This is where the headache starts. The Freedom of Access to Clinic Entrances Act (FACE Act) was signed by Clinton in 1994. It was made to stop anti-abortion activists from physically blocking abortion clinics or murdering doctors.
But, like all government bills, it has fine print. It has TWO parts:
Protects abortion clinics.
Protects people exercising religious freedom at places of worship.
That second part was a bone thrown to Republicans back in '94. It has almost never been used to prosecute a protest at a church. Until now.
The penalties? The first time is up to a year in jail and $10k. Second offense? 3 years.
Who Else Has Been Charged? (The "Both Sides" Hypocrisy)
Here comes the bullshit.
Under Biden, the DOJ went absolute ham on the FACE Act against pro-life protesters. They convicted 23 people. We are talking about old ladies. One woman was 75. Another was an 89-year-old Holocaust survivor. They were sentenced to federal prison time for blocking clinic doors.
The Left? They cheered. They loved it. "Lock 'em up! The law is the law!"
The Right? They screamed "Weaponization!" They called it a two-tiered justice system.
Fast forward to NOW.
On January 23, 2025 Trump pardoned ALL 23 of those FACE Act violators. His DOJ put out a memo saying they were scaling back FACE Act prosecutions for abortion stuff, effectively neutering the law. Republicans in Congress, led by Chip Roy, introduced H.R. 589 to repeal the FACE Act entirely. They called the law unconstitutional trash.
But wait! Suddenly, a liberal journalist walks into a church.Coincidence? Maybe.
What does that same Administration do? Do they stand by their principle that the FACE Act is bad law?
They picked up the "unconstitutional trash" law, dusted it off, and beat Don Lemon over the head with it.
The hypocrisy is blinding. The Left loved the FACE Act when it jailed grandmas, now they hate it because it jailed Don Lemon. The Right hated the FACE Act when it jailed grandmas, tried to repeal it, and now they are high-fiving each other because it jailed Don Lemon.
If you are cheering for this arrest after spending four years crying about the DOJ being weaponized, you are a hypocrite. Point blank.
"SO WHAT"
This brings us to the honest conversation nobody wants to have because it requires nuance, and nuance is dead in America.
Journalism vs. Activism: Lemon says he was reporting. The DOJ says journalism isn't a "Get Out of Jail Free" card for criminal conspiracy.
Where does the line end? Lemon had advance knowledge. He withheld the location. He called it a "clandestine mission." He said the point was to "disrupt." If you drive the bank robbers to the bank and film them robbing it, are you a reporter or an accomplice?
However, charging a journalist for being present at a disruption is a slippery slope. A law professor from Pittsburgh noted that just being there doesn't make you a criminal. And remember Judge Schiltz? He looked at the facts and said there wasn't enough there for an arrest warrant. The DOJ had to force it.
This matters because in 2025, 32 journalists were arrested. Most of them at immigration protests. If the government can arrest you for filming a protest they don't like, we are in trouble.
THE BOTTOM LINE
I’m tired, folks. I’m tired of the game.
To the Left: If you popped champagne when the Biden DOJ used the FACE Act to lock up elderly pro-life protesters, you don't get to cry "fascism" now. You handed the government a loaded gun, and now you’re shocked they pointed it at your guy. The law is either just, or it isn't. Pick one.
To the Right: If you spent years screaming about the weaponization of the Justice Department, if you pardoned people convicted under this exact law, if you tried to repeal this law last week, and then you turned around and used it to arrest a journalist just because he’s a liberal... that’s not justice. That’s revenge wearing a badge. You are doing exactly what you accused the other side of doing.
To everyone else: Watch the tape. Read the indictment. Stop letting Rachel Maddow or Sean Hannity tell you how to feel. The facts are right there. Lemon acted like an activist, not a reporter. The protesters were out of line terrorizing a church. And the government is using a zombie law to settle a political score.
Nobody looks good here. Everyone sucks.
The courts will sort this out, assuming they aren't bought and paid for too. In the meantime, try to think for yourself. It’s the only freedom you have left.
